1. Introduction

Welcome to VeerCast, a live video streaming service provided by VeerCast Digital Media, LLC. These terms and conditions govern your use of our service and website. By using VeerCast, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of them, you must not use VeerCast.

2. Service

VeerCast provides users with a live video streaming platform, allowing them to stream and watch live video content. We reserve the right to update and improve the service at any time.

3. Use of VeerCast

You must not use VeerCast for any illegal or unauthorized purpose. You must not, in the use of VeerCast, violate any laws in your jurisdiction (including but not limited to copyright laws).

4. User-generated content

All content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such content. We may not monitor or control the content posted via VeerCast and, we cannot take responsibility for such content.

5. Intellectual Property

The technology and software underlying VeerCast or distributed in connection therewith are proprietary to us. You agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying VeerCast or distributed in connection therewith.

6. Indemnification

You agree to indemnify and hold us, and our subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of VeerCast, your violation of these terms and conditions, or your violation of any rights of another.

7. Limitation of Liability

In no event shall we, our officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of VeerCast, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from VeerCast, (iv) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through VeerCast by any third party, and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, transmitted, or otherwise made available via VeerCast, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

8. Severability

If any provision of these terms and conditions is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of these terms and conditions.

9. Entire Agreement

These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us in relation to your use of VeerCast, and supersede all previous agreements in respect of your use of this service.

10. Fair Use

VeerCast is intended for personal, non-commercial use. Any unauthorized commercial use of VeerCast, or the resale of its services, is strictly prohibited. We reserve the right to limit your use of VeerCast if we determine that your usage is excessive or unreasonable in relation to personal use. Excessive use may result in the suspension or termination of your account without notice.

11. Streaming Content

You acknowledge and agree that all streaming content accessed through VeerCast is the sole responsibility of the entity that makes such content available. We do not guarantee the accuracy, completeness, or usefulness of any streaming content, and are not responsible for any errors or omissions in the content.

12. Live Streaming

VeerCast allows for live streaming of video content. By using the live streaming feature, you agree to comply with all local and national laws and regulations regarding live streaming, and to obtain any necessary permissions or licenses for any content you may stream live.

13. Copyright Infringement

VeerCast respects the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us at [email/contact form] with the following information:

• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
• A description of the copyrighted work that you claim has been infringed;
• A description of where the material that you claim is infringing is located on the site;
• Your address, telephone number, and email address;
• A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

14. Streaming Quality

VeerCast strives to provide the best streaming quality possible, but we do not guarantee that the streaming quality will be uninterrupted or error-free. Streaming quality may be affected by a number of factors, including but not limited to the user's internet connection, the quality of the user's device, and the number of users accessing the service at the same time.

15. Streaming Availability

VeerCast reserves the right to change the availability of streaming content at any time, and to remove streaming content from the service at any time without notice. We also reserve the right to limit or restrict access to streaming content in certain regions, or to certain users, at any time.

16. User Accounts

To use certain features of VeerCast, you may need to create a user account. You are responsible for maintaining the confidentiality of your account information and for any and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

17. Advertising and Promotions

VeerCast may display advertisements and promotions from third parties on the service. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through VeerCast, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. We shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of third-party advertisers on VeerCast.

18. Termination

We reserve the right to terminate your use of VeerCast at any time, without notice, for any reason, including but not limited to violations of these terms and conditions.

19. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the Kentucky, without giving effect to its conflict of law provisions.

20. Dispute Resolution

Any dispute arising out of or relating to these terms and conditions or VeerCast shall be resolved through binding arbitration in accordance with the rules of the Kentucky Arbitration Association.

21. Changes to Terms

We reserve the right, at our sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such changes and/or modifications shall become effective immediately upon the posting thereof. Please review the terms and conditions periodically. Your continued use of VeerCast following the posting of changes and/or modifications will constitute your acceptance of the revised terms and conditions.

 

Youtube Chromless Action Script 3.0 Player API

LiveSportscaster uses YouTube's action script 3.0 player API in the method of embedding youtube videos in third party players.  LiveSportscaster's use of this API respects YouTube's Terms and in no way removes adsense advertising, or YouTube branding.  YouTube's API TOS can be found HERE.

VeerCast Digital Media, LLC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.
